The terms “we”, “us” and “our” refer to Brightmore Kids. Brightmore Kids operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Brightmore Kids is powered by Shopify, which enables us to provide the Services to you.

We reserve the right to update or change these terms at any time, and continued use of our website indicates acceptance of any changes.

We encourage you to read these Terms and Conditions, and contact us if you have any particular questions in relation to browsing and shopping online with us. By accessing or using the Site, you are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms and Conditions.

You may be accessing the Site from a computer or mobile device and these Terms of Use govern your use of the Site, regardless of the means of access.


OUR PRODUCTS 
We take care to ensure all product descriptions, images, and pricing are accurate and current. However, we do not warrant that all information is error-free or complete.
Occasionally, product colours may vary slightly due to individual screen settings or handmade variations.

We reserve the right to:

  • Correct any errors or omissions at any time without prior notice.

  • Limit the sale of any product or service to particular regions or customers.

  • Discontinue products at any time.

PRICING AND PAYMENTS
All prices are listed in Australian Dollars (AUD) and include GST unless stated otherwise.
Payment must be received in full at the time of purchase via our approved payment methods (e.g. Shopify Payments, PayPal, Afterpay).
We reserve the right to change prices, discounts and promotions without notice. Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties.

We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern. 

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorised to use such credit card for the purchase, (iii) charges incurred by you will be honoured by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

ORDERS
When you place an order, you are making an offer to purchase. Acceptance of your order or booking, and completion of the contract between you and Brightmore Kids will be completed when we (or our authorised agents) email you to confirm the goods have been dispatched and have been handed over to the designated carrier.

We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Brightmore Kids may be unable to accommodate cancellation requests after an order is accepted. Completion of orders is subject to availability of the goods and/or services. 

We reserve the right not to accept your order in the event that we are unable to obtain authorisation for payment, that the item ordered is out of stock, the services are unavailable or that you do not meet the eligibility criteria set out, or otherwise contemplated, within the Terms and Conditions.

Brightmore Kids reserves the right to refuse to process or refuse service to anyone at any time at our sole discretion.

Brightmore Kids reserves the right to restrict multiple quantities of an item, or restrict the number of items being shipped to any one customer or postal address.

SHIPPING AND DELIVERY
Brightmore Kids offers free Standard delivery (2-5 days) on orders over $150 excluding Bulky Goods. For orders under $150 shipping prices will be calculated at checkout.

We aim to dispatch all orders promptly. Estimated delivery times are provided as a guide only and may vary depending on carrier delays, location, or public holidays, promotional periods, wild weather, or unforeseen or unavoidable events beyond Brightmore Kids reasonable control.

ERRORS, INACCURACIES AND OMISSIONS
We attempt to be as accurate as possible when describing our products and services on the Site, however, to the extent permitted by applicable law, we do not warrant that the product or service descriptions, colours, ingredients, information or other content available on or via the Site are accurate, complete, reliable, current, available or error-free. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).


INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Brightmore Kids. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. 

Brightmore Kids’s names, logos, product and service names, designs, and slogans are trademarks of Brightmore Kids or its affiliates or licensors. You must not use such trademarks without the prior written permission of Brightmore Kids. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners. 

SECURITY

RELATIONSHIP WITH SHOPIFYBrightmore Kids is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Brightmore Kids. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Brightmore Kids, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Brightmore Kids. 

EMAIL DATATBASE
By providing your email address or mobile number and agreeing to receive marketing communications you agree your email address, mobile number and any other personal information will be safely stored in our database. We do not share or sell this information with anyone. You can unsubscribe any time by clicking on the unsubscribe link at the bottom of any email or SMS. 

Limitation of Liability

To the extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages arising from your use of our products or website.
Our total liability shall not exceed the total amount paid for the product or service purchased.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of New South Wales, Australia.
Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
